We may share your personal data to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other legal requests for information that we may receive or to protect our rights in another way.

Behavioral Advertising

As described above, we use your personal data to provide you with targeted advertisements or marketing communications that we believe may be of interest to you.

Use of personal data

We use personal data to provide our services, which include: offering products for sale, processing payments, shipping and fulfilling your order and to keep you updated on new products, services and offers.

Legal base

According to the General Data Protection Regulation (“GDPR”), if the user is a resident of the European Economic Area (“EEA”), we process your personal data according to the following legal bases:

User permission;

The execution of the contract between the user and the Site;

Compliance with our legal obligations;

To protect the user's vital interests;

For our legitimate interests, which do not override the user's fundamental rights and freedoms.

Retention

When the user places an order through the Site, we retain his personal data for our records, unless and until he asks us to delete that information. For more information about the user's exclusion right, see the ‘User Rights’ section below.

Automatic decision making

If the user is an EEA resident, he has the right to object to processing based solely on automated decision making (which includes profiling), when that decision has a legal effect on the user or otherwise affects him significantly.

We do not engage in fully automated decision making that has a legal or otherwise significant effect using customer data.

Our Shopify processor uses limited automated decision making to prevent fraud that does not have a legal or significant effect on the user.

Services that include elements of automated decision-making include:

Temporary “blacklist” of IP addresses associated with repeated failed transactions. This “refusal list” persists for a small number of hours.

Temporary “blacklist” of credit cards associated with IP addresses listed in that list. This list persists for a small number of days.

User rights

GDPR

If the user is an EEA resident, he/she has the right to access the personal data we have about him/her, to transfer them to a new service and to request that his/her personal data be corrected, updated or deleted. If the user wishes to exercise these rights, he/she should contact us by email to geral@alata.pt, indicating the subject “GDPR”

Your personal data will initially be processed in Ireland and then transferred outside Europe for storage and further processing, including Canada and the United States. For more information on how data transfers are GDPR compliant, see Shopify's GDPR article: https://help.shopify.com/en/manual/your-account/privacy/GDPR.

A cookie is a small amount of information that is downloaded to the user's computer or device when visiting our Site. We use several different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make the browsing experience better by allowing the website to remember user actions and preferences (such as login and region selection). This means that the user does not need to enter this information again each time they return to the site or navigate from one page to another. The length of time that a cookie remains on the user's computer or mobile device depends on whether it is a "persistent" or "session" cookie. Session cookies last until the user stops browsing and persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and expire between 30 minutes and two years from the date they are downloaded to the user's device.

The user can control and manage cookies in several ways. Remember that removing or blocking cookies may adversely affect the user experience and parts of our site may no longer be fully accessible.

Most browsers automatically accept cookies, but the user can choose whether or not to accept cookies through the browser controls, usually found in the browser's "Tools" or "Preferences" menu. For more information on how to modify your browser settings or how to block, manage or filter cookies, these can be found in your browser's help file or on sites like www.allaboutcookies.org.

Also, please note that blocking cookies may not completely prevent the way we share information with third parties, such as our advertising partners. To exercise your rights or choose to opt-out of certain uses of your information by these parties, follow the instructions in the “Behavioral Advertising” section above.

No tracking

Please note that because there is no consistent industry understanding of how to respond to “Do not track” signals, we do not change our data collection and usage practices when we detect such a signal in your browser.

Change

We may update this Privacy Policy from time to time to reflect, for example, changes in our practices or for other operational, legal or regulatory reasons.
